Nevada Bail Bonds Process
The person is arrested, and they now are called the defendant. They are in the jail cell waiting for a hearing to get out. Loved ones are scrambling to find a Bail Bonds company to help them through the process. The judge sets bail based on the charges. Next STOP is getting all the paperwork together and putting a plan together to accommodate the finances of putting a bond in place to get the defendant, which is your loved one out of jail fast. You don’t want them in jail any longer than they have to be.
What Are The Four Types Of Bail?
Own Recognizance
The defendant can put in a request to be released on their “Own Recognizance”. The jurisdiction court will require a recommendation letter from Nevada Pretrial Services to grant the defendant’s request. If the court approves, there will be No Bail Money Required. The defendant needs to sign the release paperwork and make the commitment to show up for the hearing on the court date assigned.
Cash or Surety Bond
If the bail is set very high, or the defendant decides he cannot pay the whole amount., this is when a Bail Bonds Company should be hired. The Bail Bonds Company will require a 15% Fee (which is non-refundable) of the total bail amount set by the jurisdiction in cash to pay for the Bail Bonds Service, also to include collateral value to cover the bail amount in full. If the defendant doesn’t show up for the court date hearing, the Bail Amount is forfeited. The co-signer and defendant are responsible for paying any remaining amount of cash.
Property Bond
The State of Nevada doesn’t allow you to use your property as premium cash to bail out a defendant from jail.
Bail Bond Fee in Nevada
Nevada law states the bail bond company is to charge a fixed 15% for services provided. Some cases Bail Bonds Companies permit defendants to go on a payment plan, usually the Bail Bonds Company will work with the defendant if the bail amount is set high. There could be additional fees involved.
All in all, Bonds are designed for only one purpose and that is making sure you will show up in court while staying out of jail until the process is completed and settled.
